Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Emojify Text mobile application (the "App") operated by Nathalia Thomas @ Inventa Labs 💡 ("we," "our," or "us").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Description of Service

Emojify Text is a mobile application that:

  • Converts text input into emoji representations (up to 1,000 characters per input)
  • Uses artificial intelligence (specifically Google Gemini AI gemini-2.0-flash-lite model) to generate emoji suggestions
  • Provides up to 5 emoji options for each text input (configurable from 1 to 5)
  • Stores your conversion history locally on your device (limited to the 100 most recent conversions)
  • Supports multiple languages: English, Spanish, French, German, Italian, Japanese, Korean, Portuguese (Brazilian), Russian, and Chinese (Simplified)

3. AI-Generated Content

3.1 Nature of AI Content

The emoji suggestions provided by Emojify Text are generated by artificial intelligence (Google Gemini AI). You understand and agree that:

  • Emoji suggestions are AI-generated and may not always be accurate or appropriate
  • AI-generated content may vary for the same input
  • We do not guarantee the accuracy, relevance, or quality of AI-generated emoji suggestions
  • You are responsible for reviewing and selecting appropriate emoji suggestions

3.2 Content Appropriateness

While we implement input sanitization and configure Google Gemini AI's content filtering measures, we cannot guarantee that all AI-generated content will be appropriate for all audiences. Content filtering is performed by Google Gemini AI's safety filters, and we are not responsible for content that these filters do not catch. You are responsible for:

  • Reviewing emoji suggestions before use
  • Ensuring content is appropriate for your intended use
  • Not using inappropriate content in contexts where it may be harmful or offensive

3.3 Content Restrictions and Filtering

To maintain a safe and appropriate service, Emojify Text implements automated content filtering and restrictions. Content filtering is primarily performed by Google Gemini AI's built-in safety filters, which we configure to block inappropriate content. The App will block or reject text input that violates our content policy, including but not limited to:

  • Harassment: Content that harasses, intimidates, or threatens others
  • Hate Speech: Content that promotes hatred, discrimination, or violence against individuals or groups
  • Sexually Explicit Content: Content that is sexually explicit or pornographic
  • Dangerous Content: Content that promotes violence, self-harm, or illegal activities
  • Prompt Injection Attempts: Attempts to manipulate or exploit the AI system through injection techniques

Important: Content filtering is performed by Google Gemini AI's safety filters. We configure these filters to block inappropriate content, but we are not responsible for content that Gemini's filters do not catch or for any inappropriate content that may pass through Gemini's filtering system. You are responsible for reviewing all AI-generated content before use.

If your input is blocked due to content policy violations, you will receive an error message indicating that the content violates our content policy. Please try different words or phrases. We reserve the right to reject any content that we determine violates our content policy or these Terms.

Additionally, the App enforces input validation measures on our backend including:

  • Maximum input length limit of 1,000 characters to prevent abuse
  • Input sanitization to remove null bytes, control characters (except newlines, tabs, and carriage returns), and normalize excessive whitespace
  • Validation to detect and prevent prompt injection attacks using pattern matching and escape mechanisms
  • UTF-8 character set validation to ensure valid encoding
  • Response size limits: maximum 10 KB for JSON strings, 100 characters per emoji string, and 5 KB total response payload

4. User Responsibilities

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App to generate content that is illegal, harmful, threatening, abusive, or offensive
  • Attempt to manipulate or exploit the AI system through prompt injection or other techniques
  • Use the App in any way that could damage, disable, or impair the App or interfere with other users' access
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to access the App

4.2 Input Content

You are solely responsible for the text you input into the App. You represent and warrant that:

  • You have the right to submit the content you provide
  • Your content does not violate any laws or infringe on any third-party rights
  • Your content is not defamatory, obscene, or otherwise objectionable

5. Intellectual Property

5.1 App Ownership

The App, including its design, features, and functionality, is owned by Nathalia Thomas @ Inventa Labs 💡 and is protected by copyright, trademark, and other intellectual property laws.

5.2 User Content

You retain ownership of the text you input into the App. However, by using the App, you grant us a license to:

  • Process your text input to generate emoji suggestions
  • Transmit your text to third-party AI services (Google Gemini AI) as necessary to provide the service

5.3 AI-Generated Content

AI-generated emoji suggestions are provided for your use. You may use the emoji suggestions generated by the App for personal or commercial purposes, subject to these Terms.

6. Third-Party Services

The App relies on third-party services to function:

  • Google Gemini AI: Used to generate emoji suggestions from your text input
  • Firebase (Google): Used for backend processing and analytics

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATHALIA THOMAS @ INVENTA LABS 💡 SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR USE
  • DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THE APP
  • DAMAGES RESULTING FROM AI-GENERATED CONTENT
  • DAMAGES RESULTING FROM THIRD-PARTY SERVICE FAILURES

7.3 AI Content Disclaimer

We are not responsible for:

  • The accuracy, appropriateness, or quality of AI-generated emoji suggestions
  • Any consequences resulting from your use of AI-generated content
  • Content generated by third-party AI services (Google Gemini AI), including content that passes through Gemini's safety filters
  • Content that Gemini's safety filters fail to block or catch

8. Service Availability

We do not guarantee that the App will be available at all times. The App may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Third-party service outages (Google Gemini AI, Firebase)
  • Network connectivity issues

We reserve the right to modify, suspend, or discontinue the App at any time without notice.

9. Network Requirements

The App requires an active internet connection to function. The App:

  • Makes network calls to Firebase Cloud Functions
  • Transmits your text input to Google Gemini AI for processing
  • Uses Firebase App Check to verify app authenticity and prevent unauthorized access
  • Does not function in offline mode

Input Requirements:

  • Text input must be between 1 and 1,000 characters (after trimming whitespace)
  • Input must contain valid UTF-8 characters
  • Empty or whitespace-only inputs will be rejected

10. Age Restrictions

Emojify Text is intended for users who are at least 13 years of age. Users under 13 should not use the App without parental supervision. We reserve the right to restrict access to the App based on age.

11. Rate Limiting

To ensure fair use and prevent abuse, the App implements rate limiting:

  • Rate Limit: 10 requests per minute per user
  • Time Window: Requests are counted within a rolling 60-second window
  • Enforcement: If you exceed the rate limit, your requests will be temporarily blocked with a "Rate limit exceeded" error message
  • Rate Limit Data: Request counts and timestamps are stored in Firebase Firestore for the purpose of enforcing these limits
  • Modification: We reserve the right to modify rate limits at any time without prior notice

12. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review our Privacy Policy to understand our data practices.

13. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you violate these Terms.

You may stop using the App at any time by uninstalling it from your device.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date at the top of these Terms

You are advised to review these Terms periodically for any changes. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
